ConstructPro is committed to transparency and protecting your operational workflow. These Terms of Use govern your access to our platform. For questions regarding compliance, data usage, or enterprise-specific agreements, please contact our legal and compliance team at privacy@cnstrctpro.com.
1. Acceptance of these terms
By creating an account, accessing, or using ConstructPro (the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of the service
ConstructPro is estimating software that helps users build Bills of Quantities, generate material take-offs, cost labor crews, and reference pricebook data. Figures produced by the Service — including quantities, unit prices, take-offs, labor costs, schedules, and totals — are calculated estimates based on the inputs, formulas, and reference data available at the time of use. They are provided for planning and reference purposes only and do not constitute a professional quantity survey, structural design, engineering certification, or a guarantee of actual project cost, quantity, or schedule.
3. Your responsibility for how you use the service
You are solely responsible for reviewing, verifying, and independently validating any output from the Service — including estimates, take-offs, and cost figures — before relying on it for bidding, procurement, budgeting, construction, or any other decision. Local pricing, material availability, labor rates, code requirements, and site conditions change over time and by location; the Service's reference data and defaults may not reflect current conditions in your area. Always confirm figures with a licensed professional, current supplier quotes, and applicable codes before acting on them.
4. Accounts
You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at support@cnstrctpro.com if you suspect unauthorized use of your account.
5. Subscriptions, billing & free trials
Paid plans are billed in advance on a recurring basis (monthly or annual) unless stated otherwise. Free trials, where offered, may have limited functionality and will convert to a paid plan or expire according to the terms shown at signup. You can cancel a subscription at any time through your account settings; cancellation takes effect at the end of the current billing period, and fees already paid are generally non-refundable except where required by law.
6. Acceptable use
You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to the Service or other users' data; reverse-engineer, scrape, or resell the Service without permission; upload malicious code; or interfere with the Service's normal operation. We may suspend or terminate accounts that violate these Terms.
7. Your content and data
You retain ownership of the project data, quantities, and files you enter into the Service. You grant us a limited license to host, process, and display that content solely to operate and improve the Service on your behalf. You are responsible for having the rights to any content you upload.
8. Intellectual property
The Service, including its software, design, pricebook structures, and branding, is owned by ConstructPro and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets beyond what is necessary to use the Service as intended.
9. Disclaimer of warranties
THE SERVICE AND ALL OUTPUT (INCLUDING ESTIMATES, TAKE-OFFS, PRICEBOOK FIGURES, AND SCHEDULES) ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING — WITHOUT LIMITATION — WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY FIGURE IT PRODUCES WILL MATCH ACTUAL COSTS OR QUANTITIES ON YOUR PROJECT.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CONSTRUCTPRO, ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE OF ANY KIND — INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOST PROFITS, LOST DATA, COST OVERRUNS, PROJECT DELAYS, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, ANY RELIANCE PLACED ON ESTIMATES OR OTHER OUTPUT GENERATED BY THE SERVICE, OR ANY ERROR, OMISSION, OR INACCURACY IN THAT OUTPUT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHERE LIABILITY CANNOT BE FULLY EXCLUDED UNDER APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS (US$100), WHICHEVER IS GREATER.
11. Indemnification
You agree to defend, indemnify, and hold harmless ConstructPro, its owners, employees, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from or resulting from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your content or data uploaded to the Service, including any claims that your content infringes the intellectual property or privacy rights of a third party; or (iv) any claim that an estimate, take-off, or output generated by you using the Service caused financial harm to a third party. ConstructPro reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.
12. Third-party services
The Service may integrate with third-party providers, including payment processors, to deliver certain features. We are not responsible for the availability, content, or practices of third-party services, and your use of them is subject to their own terms.
13. Termination
We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms. You may stop using the Service and close your account at any time. Provisions that by their nature should survive termination (including Sections 9–11) will survive.
14. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as posting the updated Terms on this page with a new “Last updated” date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Governing law
These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles. You explicitly agree that any legal action, suit, or proceeding arising out of or relating to these Terms or the Service shall be filed exclusively in the competent courts of Caloocan City, Philippines, and you hereby consent and submit to the personal jurisdiction of such courts for the purpose of litigating any such action.
16. Severability and Integration
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Instead, such provision shall be changed and interpreted to best accomplish the objectives of the original provision to the fullest extent permitted by applicable law, and the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and ConstructPro regarding the Service and supersede any prior agreements.
